1. Service Scope. Mymaintenancesoftware provides a digital platform for maintenance management and operational task organization. The software is delivered as a hosted solution; no on-premise installation is included unless explicitly agreed in writing.
2. User Responsibilities. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to comply with this obligation.
3. Data Accuracy. All equipment data, work order histories, and inventory records are provided by you or your authorized users. Mymaintenancesoftware does not independently verify the accuracy of user-submitted data and disclaims any liability for decisions based on incomplete or incorrect entries.
4. Availability & Uptime. We aim for 99.5% platform availability measured monthly, excluding scheduled maintenance windows (notified at least 48 hours in advance) and events beyond our reasonable control, such as internet outages or force majeure.
5. Third-Party Integrations. Where the platform connects with third-party services (e.g., ERP systems, IoT sensors), we act only as a data conduit. We do not guarantee the performance, security, or continued availability of those external services.
6. Limitation of Liability. To the maximum extent permitted by law, Mymaintenancesoftware’s aggregate liability for any claim arising from the use of the platform shall not exceed the total fees paid by you in the twelve months preceding the event giving rise to the claim. This limitation applies regardless of the form of action, whether in contract, tort, or otherwise.
